General Terms and Conditions of Sale

These terms and conditions apply exclusively between M.D.M. Italia SRL, with registered office at Via Giuseppe Garibaldi 5, 09125 Cagliari (CA), hereinafter referred to as "La Revêche", and any person making online purchases on the website www.lareveche.com, hereinafter referred to as the "CUSTOMER". These terms and conditions may be subject to amendments, and the date of their publication on the website shall be deemed the date of entry into force. These terms and conditions govern purchases made on www.lareveche.com, in accordance with the provisions of Part III, Title III, Chapter I, of the Italian Consumer Code, Legislative Decree no. 206/2005, as amended by Legislative Decree no. 21/2014 and Legislative Decree no. 70/2003 on electronic commerce.
Subject Matter of the Contract

Under these General Terms and Conditions of Sale, La Revêche sells and the CUSTOMER purchases at a distance the tangible movable goods listed and offered for sale on www.lareveche.com.

The contract is concluded exclusively via the internet, through the CUSTOMER's access to www.lareveche.com and the placement of a purchase order in accordance with the procedure set out on the website.

The CUSTOMER undertakes to review these General Terms and Conditions of Sale — in particular the pre-contractual information provided by La Revêche — prior to confirming their order.
Pre-Contractual Information for the Consumer – Art. 49 of Legislative Decree 206/2005

Prior to the conclusion of the purchase contract, the CUSTOMER acknowledges the characteristics of the goods as described in the individual product pages at the time of selection.

Prior to the conclusion of the purchase contract and before validating the order with "obligation to pay", the CUSTOMER is informed of the following:

  • total price of the goods, including a breakdown of shipping costs and any other applicable charges (subject to the provisions of Article 6 for countries outside the European Union);

  • payment methods;

  • the timeframe within which La Revêche undertakes to deliver the goods;

  • conditions, timeframes, procedures and any costs associated with exercising the right of withdrawal (Art. 7 of these terms and conditions);

  • existence of the statutory guarantee of conformity for the purchased goods;

  • after-sales assistance conditions and commercial warranties provided by La Revêche.

The CUSTOMER may at any time, and in any case prior to the conclusion of the contract, access information relating to La Revêche, including its registered address, telephone number and email address.
Formation and Effectiveness of the Contract

The sales contract shall be deemed concluded upon La Revêche sending the CUSTOMER an order confirmation email.

The email includes the CUSTOMER's details and order number, the price of the purchased goods, any applicable shipping costs, the delivery address to which the goods will be dispatched, and a link to the website to print and save a copy of these terms and conditions.

The CUSTOMER undertakes to verify the accuracy of the personal data contained therein and to promptly notify La Revêche of any corrections required.

The CUSTOMER may cancel the order placed within no later than one hour from receipt of the order confirmation email (cancellations and modifications of orders are not permitted during Black Friday and Cyber Monday week).

La Revêche undertakes to describe and present the items sold on the website as accurately as possible. Nonetheless, certain errors, inaccuracies or minor discrepancies between the website and the actual product may occur. Furthermore, product images displayed on www.lareveche.com do not form part of the contractual terms, as they are for illustrative purposes only.

La Revêche undertakes to deliver the goods within 20 days from the date of the order confirmation email sent to the CUSTOMER, and accepts no liability in the event that delivery fails to occur due to circumstances not attributable to La Revêche.
Product Availability

Product availability refers to actual stock availability at the time the CUSTOMER places the order. Such availability must nonetheless be considered indicative only, as — due to the simultaneous presence of multiple users on the website — products may be sold to other CUSTOMERS prior to order confirmation.

Even following the dispatch of the order confirmation email by La Revêche, cases of partial or total unavailability of goods may occur. In such event, the order will be automatically amended by removing the unavailable product, and the CUSTOMER will be promptly notified by email.

In such cases, the CUSTOMER shall have the right to request a refund of the amount paid, which will be processed within 14 days of the request, or to wait for the item to be restocked.
Payment Methods

All payments by the CUSTOMER shall be made exclusively by credit card or debit card on www.lareveche.com.
Prices

All product sale prices listed on www.lareveche.com are inclusive of VAT for the territory of the European Union. Shipping costs are included in the purchase price.

The CUSTOMER acknowledges La Revêche's right to amend its prices at any time. However, goods will be invoiced at the prices indicated on the website at the time the order is placed and as stated in the order confirmation email sent by La Revêche to the CUSTOMER.

In the event of a system, manual, technical or any other type of error resulting in a substantial and unintended change to the retail sale price — rendering it either excessively high or clearly negligible — the purchase order shall be deemed invalid and cancelled, and the amount paid by the CUSTOMER shall be refunded within 30 days from the date of cancellation.

Access to the Website

The CUSTOMER is entitled to access the website for browsing and purchasing purposes. No other use of the website or its content — in particular for commercial purposes — is permitted. The integrity of the elements of this website, whether audio or visual, and the related technology, remain the exclusive property of M.D.M. ITALIA SRL and are protected by intellectual property rights.

La Revêche accepts no liability for service disruptions attributable to force majeure or unforeseeable circumstances, including those arising from malfunctions or disruptions to the internet network, in the event that it is unable to fulfil the order within the contractual timeframes.
Severability

These General Terms and Conditions of Sale comprise all the clauses set out herein. If one or more provisions of these General Terms and Conditions of Sale are deemed invalid or declared as such under applicable law, regulation or by a decision of a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
Governing Law and Jurisdiction

These Terms and Conditions of Use and Sale are drawn up in accordance with, and governed by, Italian law, to the exclusion of any rules of private international law that may otherwise apply.

Any dispute arising from the interpretation, validity, performance, fulfilment or termination of these Terms and Conditions of Use and Sale shall be subject to the exclusive and mandatory jurisdiction of the court of the place where you are resident or domiciled.

In any case, you may have recourse to alternative dispute resolution procedures, as set out in Articles 141 to 141-decies of the Italian Consumer Code. The European Commission's Online Dispute Resolution platform is available at http://ec.europa.eu/odr.
